Welcome to BarWars. These Terms of Service ("Terms") govern your use of the BarWars mobile application, website, and related services (collectively, the "Service") operated by BarWars ("we," "our," or "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old to use BarWars. Certain features, including turf war participation and check-in verification, require a valid .edu email address from an accredited college or university. By using the Service, you represent that you meet these requirements.
BarWars is a gamification platform for nightlife engagement. The Service does not sell, distribute, or facilitate the purchase of alcohol. Any promotions, offers, or rewards displayed in the app are provided by participating bars at their sole discretion and subject to applicable laws, including legal drinking age requirements.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use.
One account per person. One verified account per device. Creating multiple accounts, using another person's account, or circumventing device verification will result in immediate suspension.
Battle Bonds are purchased with real currency by Greek organizations through the app. All Battle Bond purchases are final and non-refundable. Battle Bonds have no cash value and cannot be converted back to real currency. The platform retains 15% of each purchase as a service fee, and 10% is automatically diverted to the Pledge Fund as Legacy Bonds.
Valor Bonds are earned through gameplay activity (check-ins, bracelet donations, predictions, contracts). Valor Bonds have no cash value, cannot be purchased, and cannot be transferred between users. Valor Bonds may be redeemed at participating bars according to each bar's redemption menu. We do not guarantee the availability, value, or continuation of any bar's redemption offers.
Legacy Bonds are diverted automatically from Battle Bond purchases into the Pledge Fund. Legacy Grants are issued at the sole discretion of BarWars based on eligibility criteria (minimum 500 Valor Bonds earned). Legacy Grants are not guaranteed and are subject to fund availability.
We reserve the right to modify the War Bond economy, including exchange rates, earning mechanisms, and redemption values, at any time with reasonable notice.
Skins, Deception rentals, Mole Scanners, and other virtual items are purchased through the app using real currency processed by Stripe or Apple's in-app purchase system. All purchases of virtual items are final and non-refundable except as required by applicable law or platform policy (Apple App Store, Google Play).
Virtual items have no real-world value. They exist only within the Service and cannot be sold, traded, or transferred outside the platform. We reserve the right to modify, discontinue, or adjust the pricing of virtual items at any time.
BarWars is a competitive platform. You agree to play fairly and abide by the following rules:
We reserve the right to suspend or terminate accounts, revoke War Bonds, remove skins, and take any action necessary to maintain game integrity.
War Comms channels allow you to send text messages to other users. You are solely responsible for the content of your messages. You agree not to post content that:
We may, but are not obligated to, monitor, review, or remove user content at our discretion. Other users may flag messages for review. Violations may result in message removal, temporary muting, or permanent account suspension.
By posting content through the Service, you grant BarWars a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content within the Service for the purpose of operating the platform.
BarWars partners with local bars and venues ("Participating Bars") to provide the turf war, flare, bracelet drop, and redemption features. Participating Bars are independent businesses and not agents, employees, or affiliates of BarWars.
We do not control and are not responsible for the products, services, offers, pricing, or conduct of any Participating Bar. Redemption of Valor Bonds is subject to each bar's availability, terms, and discretion. We do not guarantee that any offer, promotion, or redemption will be honored.
BarWars is not responsible for your experience at any Participating Bar, including but not limited to service quality, safety, or compliance with applicable laws.
BarWars does not sell alcohol. The Service is a gamification layer that operates alongside but independently of alcohol service at Participating Bars. All alcohol service is governed by the Participating Bar's liquor license and applicable state and local laws.
You acknowledge that attending bars and consuming alcohol involves risks. You agree to act responsibly, comply with all applicable laws (including legal drinking age requirements), and not use the Service while impaired. BarWars does not encourage excessive drinking or underage drinking.
If any game mechanic (Rally calls, Shots Fired, turf defense) encourages you to travel to a venue, you are solely responsible for your transportation and safety. Never drink and drive.
Certain features require access to your device's location services. You may grant or revoke location permissions at any time through your device settings. Disabling location services may limit functionality, including the War Map live radar, check-in verification, and war zone skin transitions.
We use location data as described in our Privacy Policy. We do not sell location data to third parties.
The Service, including its design, features, code, graphics, War Bond economy mechanics, skin system, and all original content, is owned by BarWars and protected by copyright, trademark, and other intellectual property laws. "BarWars," "Nightlife Never Dies," "Shots Fired," "War Bonds," "Valor Bonds," "Battle Bonds," "Legacy Bonds," "Scorched Earth," "War Locker," "Bar Command Center," and related marks are trademarks of BarWars.
You may not copy, modify, distribute, sell, or create derivative works based on the Service without our written permission.
Greek organizations and Hessian Companies may create custom squad skins, channel names, and other content representing their organization. Organizations are responsible for ensuring they have the right to use any names, logos, crests, or symbols they upload. BarWars is not responsible for trademark disputes between organizations.
If you believe content on the Service infringes your intellectual property rights, contact us at legal@barwars.app with a detailed description of the claimed infringement.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Game mechanics, including turf ownership, War Bond balances, prediction outcomes, skin availability, and leaderboard rankings, are subject to system operation and may be affected by bugs, outages, or maintenance. We do not guarantee the accuracy or permanence of any game state.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARWARS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO BARWARS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION, INCLUDING BUT NOT LIMITED TO BREACH OF CONTRACT, TORT, NEGLIGENCE, AND STRICT LIABILITY.
You agree to indemnify, defend, and hold harmless BarWars, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, your content posted through War Comms, or your conduct at any Participating Bar.
We may suspend or terminate your account at any time for violation of these Terms, cheating, abusive behavior, or any reason at our discretion. Upon termination, your right to use the Service ceases immediately. War Bonds, skins, and other virtual items associated with a terminated account are forfeited and non-refundable.
You may delete your account at any time in the app under Account > Delete Account, or by emailing support@barwars.app. Account deletion is permanent.
These Terms are governed by the laws of the State of Mississippi without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in Oxford, Mississippi, conducted by a single arbitrator under the rules of the American Arbitration Association. You waive any right to a jury trial or participation in a class action.
For disputes involving less than $1,000, either party may elect to resolve the dispute through small claims court in Lafayette County, Mississippi.
We may modify these Terms at any time. Material changes will be communicated through the app or by email at least 14 days before taking effect. Continued use of the Service after modifications constitutes acceptance. If you disagree with changes, your remedy is to stop using the Service and delete your account.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and BarWars regarding the Service. These Terms supersede all prior agreements, communications, and understandings.
